Definitions/legal glossary

Settlement agreements
formerly known as compromise agreements are legally binding contracts between employers and employees that waive an employee’s rights to make any claims which are listed in the agreement to an Employment tribunal or Court. The benefit to an Employer is that the Employee cannot bring a claim against the Employer in the future while the Employee often has the benefit of a tax free lump sum.

Settlement agreement must be in writing; relate to a particular complaint or proceedings and must state that the applicable statutory conditions regulating the settlement agreement have been met. The employee must have received advice from an identified relevant independent adviser, the independent adviser must have a current contract of insurance or professional indemnity covering the risk of a claim by the employee in respect of loss arising from the advice.
